MOTORCYCLE TRANSPORT NON-LIABILITY DISCLAIMER AND RELEASE OF CLAIMS

This Non-Liability Disclaimer and Release of Claims ("Agreement") is made between Certified Knee Draggers, ("Transporter") and ("Customer"), for transport of Customer's motorcycle(s) described below:

Vehicle Information is kept on file in company records

Disclaimer and Release:

1. Customer acknowledges Transporter is not liable for any damages, losses, or claims arising from:

    - Transportation of motorcycle(s) by land, sea, or air.

    - Loading/unloading procedures.

    - Storage of motorcycle(s) at any facility.

    - Acts of God, weather conditions, or unforeseen circumstances.

    - Mechanical failure or pre-existing conditions of motorcycle(s).

2. Customer releases Transporter from any claims, demands, or causes of action for:

    - Property damage or loss.

    - Personal injury or death.

    - Any indirect, incidental, special, or consequential damages.

3. Customer verifies motorcycle(s) are:

    - In good working condition before transport.

    - Properly prepared for transport (e.g., fuel drained, batteries disconnected).

    - Insured for transit coverage (if applicable).

Assumption of Risk:

Customer acknowledges transporting motorcycle(s) involves inherent risks and assumes all liability for any damages or losses.

Customer Acknowledgement:

By Utilizing Services provided by Transporter, Customer acknowledges reading, understanding, and agreeing to this Non-Liability 

PARTICIPATION AGREEMENT AND WAIVER OF LIABILITY

  1. ACCURATE SKILL LEVEL REPRESENTATION: You affirm that you have truthfully chosen your rider skill level to participate in this group's activities, including track days and other motorcycle-related events.
  2. ASSUMPTION OF RISK: You acknowledge that participating in motorcycle events involves inherent risks, including physical injury or death, and assume all liability for any damages or losses.
  3. LEVEL VERIFICATION AND PARTICIPATION LIMITATIONS: If at any time during the event, Certified Knee Draggers staff or instructors identify you as a rider lacking skills for your registered level, you may be prevented from continuing to participate. This decision is final and non-negotiable.
  4. NO REFUNDS FOR EARLY TERMINATION: Partial refunds WILL NOT be provided if your participation is terminated due to skill level misrepresentation or failure to meet required standards.
  5. RELEASE OF LIABILITY: You release and hold harmless Certified Knee Draggers, its officers, directors, employees, agents, and affiliates from any claims, demands, or causes of action arising from your participation in group activities.
  6. RULES AND REGULATIONS ACKNOWLEDGMENT: You agree to abide by all rules and regulations set forth for Certified Knee Draggers events, including those outlined in the:

      2.     - Certified Knee Draggers Privacy Policy
  7. INDEMNIFICATION: You agree to indemnify Certified Knee Draggers against any claims, damages, or expenses arising from your breach of this agreement or negligence during events.
  8. FAILURE TO COMPLY MAY RESULT IN EJECTION: Failure to observe these regulations may result in immediate ejection from the event without refund.
  9. REFUND/CANCELLATION POLICY ACKNOWLEDGMENT: You understand and agree to the refund/cancellation policy as described on the Certified Knee Draggers Privacy Policy
  10. GOVERNING LAW: This agreement shall be governed by and construed in accordance with New York State laws.

2. General Safety Guidelines

- Always wear proper protective gear, including helmets, gloves, and closed-toe shoes.

- Ensure motorcycles are in good working condition before transport or track use.

- Follow all traffic laws and regulations during transport.

- Be aware of surroundings and potential hazards at all times.

3. Motorcycle Transport Safety

- Motorcycles must be properly secured during transport using certified tie-downs and straps.

- Transport vehicles must be equipped with proper safety equipment, including fire extinguishers and first aid kits.

- Drivers must be experienced and licensed for motorcycle transport.

4. Track Day Safety

Certified Knee Draggers prioritizes safety during track days. Riders must adhere to these guidelines to ensure a secure environment: See Track Day manual for more details

5. Rider Conduct and Responsibility

- Riders must sign a waiver and release form before participating in track days.

- Riders are responsible for their own safety and the safety of others on track.

- Aggressive riding behavior will not be tolerated.

- Riders must follow flag signals and track instructions at all times.

6. Emergency Procedures

- In case of an accident or injury, alert track staff immediately.

- Track staff are trained in first aid and emergency response.

- Fire extinguishers and emergency equipment are located throughout the track.

- Emergency contact information must be provided during registration.

7. Incident Reporting and Investigation

- All incidents, including accidents and near misses, must be reported to track staff.

- Incident reports will be filed and reviewed to prevent future occurrences.

- Riders involved in incidents may be subject to disciplinary action.

Track Day Safety

Pre-Track Briefing

- Mandatory attendance for all riders before first track session

    - Track layout and conditions

    - Flag signals and meanings

    - Passing rules and zones

    - Emergency procedures

    - Certified Knee Draggers rules and regulations

Rider Conduct

- Ride defensively and predictably

- Maintain safe following distances (minimum 2-3 seconds)

- No aggressive passing or braking

- Respect faster/slower riders and yield when necessary

- Avoid sudden movements or changes in direction

Track Rules

- Passing zones designated by Certified Knee Draggers staff

- No passing in braking zones or corners

- Use of signals required when changing direction or passing

- Respect track limits – avoid crossing kerbs or running wide

Flag Signals

- Green flag: Track open, normal conditions

- Yellow flag: Caution – incident, debris, or hazard on track

- Red flag: Track closed – immediate return to pit lane

- Black flag: Rider dismissal – report to pit lane immediately

- Blue flag: Faster rider approaching – yield and move right

Pit Lane Safety

- Obey pit lane speed limit (typically 20-30 mph)

- Use designated entrance and exit lanes

- No passing or racing in pit lane

- Follow instructions from pit lane marshals

Incident Procedures

- Report incidents (accidents, spins, etc.) to Certified Knee Draggers staff immediately

- Move to safe location – avoid obstructing track or pit lane

Vehicle Safety Inspection

- Mandatory inspection before first track session

    - Proper tire condition and pressure

    - Functional brakes and suspension

    - Securely mounted seats and handlebars

    - Working headlights and taillights (if equipped)

Transport Safety

Certified Knee Draggers prioritizes safety during motorcycle transportation. Our transport safety guidelines ensure secure transit of vehicles:

Pre-Transport Checks

- Vehicle inspection: Ensure motorcycles are in good working condition

- Tire condition and pressure check

- Brake pad and fluid inspection

- Secure battery and electronics

Loading and Securing Vehicles

- Use certified tie-down straps and equipment

- Load motorcycles facing forward, centered on wheel chocks

- Secure vehicles to transport trailer/frame at four points:

    - Front wheel

    - Rear wheel

    - Frame (above engine)

    - Frame (below seat)

- Tighten straps evenly, ensuring 500-700 lb tension

Transport Vehicle Requirements

- Well-maintained trailers with functional brakes and lighting

- Transport vehicles equipped with:

    - Fire extinguisher

    - First aid kit

    - Reflective triangles/emergency road kit

    - GPS tracking device

Driver Requirements and Protocol

- Experienced, licensed drivers with clean records
